Recent Income Tax Update related to Individual or HUF

Dated- 12 April 2023

  • A new schema has been released by the CBDT for e-filing of ITR 1 returns for the residents (other than those not ordinarily resident)

    Read More earning an income of up to Rs 50 lakh, owning a property, earning interest, or earning income from agriculture up to Rs.5 thousand.

  • A new ITR 4 filing schema has been released by the CBDT for individuals, HUFs and firms (other than LLPs) who are residents and have a total income of up to Rs 50 lakh, and income from business and profession calculated under sections 44AD, 44ADA or 44AE, as well as agricultural income up to Rs.5 thousand

  • Clarification regarding deduction of TDS under section 192 read with sub-section (IA) of section 115BAC of the Income-tax Act, 1961

Dated 29 March 2023

Person who has failed to intimate the Aadhaar number with Pan number in accordance with section 139AA of the Income-tax Act, 1961 (the Act) read with rule 114AAA shall face the following consequences as a result of his PAN becoming inoperative.

  • Refund of any amount of tax or part thereof shall not be made to him.
  • Interest shall not be payable to him on such refund for the period, beginning with the date specified under sub-rule (4) of rule 114AAA and ending with the date on which it becomes operative.
  • Where tax is deductible under Chapter XVJJ-B in case of such person, such tax shall be deducted at higher rate i.e 20%, in accordance with the provisions of section 206AA;
  • Where tax is collectible at source under Chapter XVJJ-BB in case of such person, such tax shall be collected at higher rate i.e 20%, in accordance with the provisions of section 206CC.
  • A fee of 1000/- will continue to apply to make Linking of PAN with Aadhaar number.

  • The new mobile application Annual Information Statement(AIS)/Tax Information Summary(TIS) via the income tax department is now enabled for taxpayers.
  • Taxpayers can use the mobile app to view their information related to TDS/TCS, interest, dividends, share transactions, tax payments, Income Tax refunds, Other Information (GST Data, Foreign Remittances, etc.) as available in AIS/TIS. The taxpayer also has the option and the facility to provide feedback on the information displayed in the app.
  • To access this mobile app, the taxpayer needs to register on the app by providing PAN number, authenticate with the OTP sent on mobile number & e-mail registered on the e-filing portal Subsequent to the authentication, the taxpayer can simply set a 4-digit PIN to access the mobile app.

  • Form 26 AS will display only TDS/TCS data starting with AY 2023-24. AIS (Annual information statement) will provide information on other taxes, such as self-assessment tax, advance tax, refunds, etc.

  • Section 115BAC of Income Tax Act: Features of the New Tax Regime and Its Benefits
  • The alternate tax regime of Section 115BAC shall also apply to Individual, HUF, Association of Persons (AOP)[(other than a co-operative society], Body of Individuals (BOI), and Artificial Juridical Persons (AJP).
  • New tax regime will be the default tax regime. However, taxpayers can opt for the old regime
  • A tax rebate has been introduced under the new tax regime on income up to Rs.7 lakhs. Therefore, do not have to pay tax if your taxable income is below Rs.7 lakhs under the new tax regime
  • The tax exemption limit of Rs.2.5 lakh has increased to Rs.3 lakh under the new tax regime and tax slabs have been recalibrated under the new tax regime as follows:

  • Receipts from life insurance policies issued on or after April 1st, 2023 shall be considered as income from other sources if the premium payable for any of the previous years during the term of such policy exceeds Rs. 5 lakhs.

The Receipts from Life Insurance policies will exempted when death of insured person.
